Electronic Cigarettes in the EU: The Political Economy of Product Regulation

2015

This case study describes the regulatory challenges facing the e-cigarette industry in 2013, in the context of a proposed classification of e-cigarettes as medical devices, regardless of nicotine, integrated in the European Commission’s “Tobacco Products Directive.” Students analyze the complex regulatory environment and learn about the state of the e-cigarette industry at that time, and explore how the e-cigarette industry could achieve its goal of an outcome that is less costly and restrictive than the proposed regulations.
